High Court sentences murderer to 8 years’ imprisonment in Mzuzu
Mzuzu High Court has sentenced Wyson Chitenje ,23 to eight years’ imprisonment with hard labor (IHL) for allegedly killing a 15-year-old girl, Baby Banda in Mzimba.
According to Senior Assistant Chief State Advocate, Waliko Nkosi According, Banda now deceased had been married before to the convict and had just spent one night in the marriage.
“Her parents had taken her away from the marriage since she was too young to get married and she was found dead a week after being taken from the bridal,” said Nkosi.
He told the court that Banda was in the month of August 2017 sent by her mother to buy vegetables from a vegetable garden but did not report back home, hence her parents and relatives started searching for her but to no avail.
He said the following day, parents for Banda received a phone call to go to St Kizito area in the area of Traditional Authority Mtwalo in Mzimba Di where they found their daughter dead with blood at her private parts.
Nkosi concluded that the convict caused the death of the deceased with malice aforethought between the night of 4 and 5 September, 2017
Chitenje who was arrested on January 3, 2018 pleaded not guilty to the murder charge but he was found guilty following a full trial and convicted in October, 2021.
In mitigation, the convict said he is a first offender and he has neither any violent nor blameworthy record before committing the offence.
Judge Chimwemwe Kamowa however quashed aside the mitigation factor and Chitenje to eight years IHL for murder which is contrary to Section 209 of the Penal Code with effect from the day he was arrested.
Banda hailed from Kamphale Village in the area of Traditional Authority Kaomba in Kasungu District while Chitenje is of Katema Village in the area of Traditional Authority Mtwalo in Mzimba.
